WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY. BY SIGNING, YOU GIVE UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE.

I wish to enter and participate in the Adrenaline Night Rides. I accept the rules, conditions and regulations of this event, including course rules, cutoff times and passing etiquette, and will comply with them, along with the instructions of race officials, medical personnel, park staff and land managers. I have sufficiently trained to participate in this event and am in good health. I have no medical condition that makes my participation unsafe, or I have consulted a physician and accept that risk. I am capable of making rational decisions and judgments for my own safety and welfare.

EQUIPMENT. I will wear a properly fitted, fastened bicycle helmet at all times while on my bike, including warmups and cooldowns. I am solely responsible for the safety, condition, fit and maintenance of my bicycle and equipment, and for riding within my ability. Race officials may inspect my bike and refuse to start me if they believe it is unsafe.

ASSUMPTION OF RISK. I understand that night mountain bike racing in McDowell Mountain Regional Park is a strenuous and dangerous activity with inherent and unknown risks, including serious injury, permanent disability, paralysis, illness and death. These risks include, but are not limited to: crashes and falls at speed, at night by bike light, on rocky, loose, sandy and technical desert singletrack, washes and descents; collisions with other riders, passing and being passed, and with rocks, cactus, fixtures, spectators, volunteers, animals and vehicles; mechanical failure of my bicycle, lights or equipment, including brakes, wheels, tires, frames and components; heat, dehydration and heat illness, including on warm nights; monsoon storms, lightning, wind and dust; exhaustion and cardiac events; wildlife including rattlesnakes, scorpions, Africanized bees, coyotes and javelina; cactus and other spiny plants; sharing trails with runners, hikers, equestrians and other park users; vehicle traffic at road crossings, parking areas and on roads; becoming lost or leaving the marked course; the condition of trails, roads and facilities; the actions or inaction of other participants, volunteers, spectators and race officials; and the distance of parts of the course from aid, rescue and medical care. Knowing these risks, I freely and voluntarily accept them, whether or not they are described here, and agree to be solely responsible for my participation.

RELEASE AND WAIVER. In consideration of the acceptance of my entry, I, for myself, my heirs, executors, administrators, personal representatives, successors and assigns, waive, release and discharge the Adrenaline Night Rides, Aravaipa Running LLC and its DBAs including Aravaipa Rides, Maricopa County and the Maricopa County Parks and Recreation Department, all other landowners and land managers whose property the course, parking and event venues cross or occupy, RaceGoat and Dead Reckoning Labs, Inc., all official sponsors and beneficiaries, and the affiliates, officers, directors, members, employees, agents, contractors, volunteers, medical personnel, successors and assigns of each of them (together, the "Released Parties"), from any and all rights, claims, demands and causes of action, INCLUDING THOSE ARISING FROM THE NEGLIGENCE OF ANY RELEASED PARTY, for injury, illness, disability, death or damage to or loss of me, my bicycle or my property, arising out of or in connection with my participation in this event, practice laps, packet pickup, and any pre-race and post-race activities, and my travel to, from and around them.

INDEMNITY. I agree to defend, indemnify and hold harmless each Released Party against all claims, demands, losses and causes of action, including court costs and attorneys' fees, brought by me, on my behalf, or by anyone claiming through me, contrary to this agreement, or arising from my own conduct during the event, including any collision I cause.

MEDICAL. I consent to evaluation and treatment by the event's medical team, and to rescue and transport to an emergency facility if they believe I need it, and I am responsible for the cost of that care, rescue and transport. I agree that race officials and medical personnel may remove me from the race if, in their judgment, it is in my best interest or the event's, and I will follow that decision.

PLATE. I will not let anyone else use my registration or number plate, and I will not ride with a plate registered to someone else.

MEDIA. I grant the event, its organizers and their licensees the perpetual, worldwide right to use my name, likeness, voice, photographs, video and results, and any statements I make about my participation, in any media for any legitimate purpose, including promotion and advertising, without payment to me.

CHANGES AND CANCELLATION. Race officials may change the course, categories, laps, cutoffs or start times, or delay, shorten, suspend or cancel the event, for weather, trail conditions, fire, land manager or permit requirements, public safety or other reasons beyond their control. Entries are non-refundable and non-transferable, including in those cases. If I notify info@aravaiparides.com in writing 30 days or more before the event, I will receive a 75% credit toward a future Aravaipa Rides event. Within 30 days and up to 72 hours before the event, the race director may provide a 50% credit for an injury (with a doctor's note) or a family emergency (with documentation). No credit is provided for a relay or duo team withdrawal, or within 72 hours of the event or after it. Credits are good for one year from the date they are issued.

MINORS. If the participant is under 18 years of age, I am the participant's parent or legal guardian, I agree to all of the above on the participant's behalf and my own, I will be present on race day, and I understand that I am responsible for the participant's supervision, health and welfare throughout the event.

GENERAL. This agreement is intended to be as broad and inclusive as the law of the State of Arizona permits, and is governed by that law. If any part of it is held invalid, the rest continues in full force.

I have read this agreement, understand that I am giving up substantial rights by signing it, including the right to sue for negligence, and sign it voluntarily.
