WAIVER AND RELEASE OF LIABILITY
Grand Island Trail Runs – July 31, 2027
Assumption of Risk:
I, the undersigned, am voluntarily participating in the Grand Island Trail Runs (“Event”), fully aware of the inherent risks and dangers involved in trail running. I understand that trail running is a strenuous and potentially hazardous activity, involving known and unanticipated risks that may result in physical or emotional injury, permanent disability, paralysis, death, property damage, or other losses. I acknowledge that these risks cannot be eliminated even with the best planning and organization.
Risks include, but are not limited to:
Falls, collisions, or contact with other participants;
Hazards of rugged terrain such as rocks, roots, uneven surfaces, and steep ascents or descents;
Environmental conditions, including extreme weather, lightning, temperature extremes, and dehydration;
Encounters with wildlife or insects;
Equipment failure, inadequate safety measures, and other unanticipated risks.
Medical Fitness:
I represent and warrant that I am physically fit, sufficiently trained, and have no medical condition that would prevent my participation in the Event. I agree to cease participation immediately if I experience any health issues during the Event.
Release of Liability:
In consideration of being permitted to participate in this Event, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Aravaipa Running LLC, the race director, Great Lakes Endurance, Hiawatha National Forest, Grand Island Ferry Service, Inc., event staff, medical personnel, volunteers, sponsors, vendors, and any other affiliated individuals or entities (collectively, “Released Parties”) from any and all claims, demands, actions, or damages of any kind arising from or related to my participation in this Event. I further agree to indemnify and hold harmless the Released Parties from any liability, damage, cost, or expense, including attorneys’ fees, arising from my participation, whether caused by negligence or otherwise, to the fullest extent permitted by law.
Media Release:
I grant irrevocable permission to Aravaipa Running LLC and its agents to capture and use my name, likeness, image, voice, and/or appearance in photographs, video recordings, and other media captured during the Event. I waive any rights to royalties or other compensation arising from the use of these materials for any lawful purpose, including, but not limited to, advertising, social media, and promotional activities.
Refund and Transfer Policy:
All entry fees are non-refundable and non-transferable, regardless of circumstances. Race credit may be provided under the following conditions only:
If notified in writing to info@aravaiparunning.com 30 days prior to the Event, a 75% race credit toward a future Aravaipa Running event may be issued.
If notified 5 days prior to the Event, a 50% race credit may be provided in cases of injury or family emergency.
No race credit will be issued within 4 days of the Event or after the Event has taken place. Race credits are valid for one year from the date of issuance and may not be converted to cash or transferred.
For merchandise, tent rentals, or add-ons (excluding the standard shirt or goodie), a 100% future race credit will be issued if requested before items are ordered. After ordering, no credit or refund will be issued. Race shirts and other standard items must be picked up in person on race day; we cannot mail these items to participants who do not attend.
Additional Terms for Relay Teams and Distance Changes:
For relay teams, no refunds, transfers, rollovers, or credits will be provided for withdrawals. Team members may be changed as specified per event rules. No refunds or credits will be given for changes to a shorter race distance.
Governing Law and Jurisdiction:
This waiver is governed by the laws of the State of Arizona. Any dispute or claim arising from this waiver or participation in the Event shall be resolved in the state or federal courts located in Maricopa County, Arizona.
Severability:
If any provision of this waiver is deemed unenforceable by a court of law, the remaining provisions will remain in full effect.
Acknowledgment of Understanding:
I have read this waiver thoroughly and understand its terms. I acknowledge that I am voluntarily giving up substantial legal rights by signing it. I intend for this waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law.
One last look. Filing gives you your entry code, holds your price and any coupon or credit for 30 days, and emails you the form with instructions.
Sign on the line with the quill. One dip holds about a first name, so keep the inkwell handy. Mind the drips.
Mail-in perk: no online processing fee. You pay the base fee plus sales tax, nothing else. Make checks payable to Aravaipa Running and write your code on the memo line. All entries must be signed.
